Real Estate

Sarthak Law has an active real estate practice, which includes advising our clients in conducting real estate due diligences, ensuring compliances with laws such as RERA, and drafting and negotiating contracts, such as joint development agreements, builder-buyer agreements, sale deeds, agreements to sell, and short-term/ long term lease agreements. We also represent clients before various Real Estate Regulatory Authorities in disputes by and against real estate developers.

 

Labour and Employment

We work with several Indian and multinational clients in providing most strategic and cost effective solutions on employment and industrial labour laws. We have structured and drafted employment agreements, employment policies and procedures, policies to prevent sexual harassment at workplace, and employee benefit schemes, including employee stock option and stock purchase schemes. We  regularly advise clients on matters such as compliances with applicable employment laws, disciplinary proceedings against errant employees, and on termination procedures. We also represent clients in their disputes by employees and employers against each other, and in non-compete disputes involving multiple stakeholders. 

 

Charities

Sarthak Law has rich experience in advising clients engaged in ‘not-for-profit’ activities. We have advised several leading international not for profit organisations on aspects of Indian law governing charities. We assist clients with registration of charitable/ not-for-profit entities in the form of public charitable trusts, societies and not-for profit companies (under Section 8 of Companies Act, 2013),  and other general legal advisory relating to the day to day affairs of such entities. We also advise clients on compliances with Foreign (Contribution and Regulation) Act, 2010.

 

Estate Management and Planning

Sarthak Law regularly assists a range of clients on the comprehensive framework for estate management  and succession in India. Our counsels have distinct experience of advising clients in estate management, drafting and execution of wills and general advisory on the intricate aspects of legal framework on estate planning. We are regularly engaged by several family owned corporate houses for planning succession of their properties and businesses.

 

Alternative Investment Funds

Sarthak Law regularly advises clients on establishing alternative investment funds in India, as well as in transactions involving deployment of funds by such funds. We assist clients  in the entire range of their legal needs, including structuring of the fund, preparation of the application, and drafting of fund documentation. We have also worked with several clients in setting up India focussed offshore funds, with holding companies incorporated in tax friendly jurisdictions.

 

Competition Law

We advise our clients on aspects of anti-trust and competition law, both as part of transaction advisory services and general corporate and litigation advisory services. Our Firm’s Partner, Ms. Mani Gupta has been empaneled counsel with Competition Commission of India.

 

General Corporate Advisory

Sarthak Law assists  businesses in regular transaction advisory, and on day-to-day legal issues facing businesses. This includes advisory on in-bound investments into India as well as out-bound investments from India. We are capable of hand-holding the client through the entire transaction life-cycle, starting from structuring of the transaction (including advise on the most suitable investment vehicle) to drafting and negotiation of transaction documents. We also advise on joint ventures, technical collaborations and technology transfers, regulatory approvals and compliances.

 

Miscellaneous

We regularly provide advisory services on miscellaneous legal issues facing a commercial enterprise, such as under companies law, investment laws, sectoral laws, labour and employment laws, and environmental laws. We have a dedicated secretarial team to assist and hand-hold clients in meeting compliance requirements and deadlines.
